1. Booking and Reservation Agreement
 
By reserving a date and time on our platform, you are securing a spot for a guided outdoor experience. Reservations are confirmed only after full or partial payment is received. Once booked, you will receive a confirmation email with details about meeting locations, times, and necessary preparation.
 
2. Weather Conditions and Safety
 
Conditions on Lake Superior can change rapidly. For your safety, we reserve the right to
 
Modify the route or launch site
 
Substitute your session with an alternate guided experience of similar value
 
Partner with another trusted outfitter if necessary
 
Cancel and offer a refund only when no safe or suitable alternative is available
 
 
We do not offer refunds solely due to location changes caused by weather.
 
3. Launch Access and Locations
 
Our guided trips often launch from sandbars, docks, or by shallow wading, typically from federal waters or tribal access areas to ensure flexibility and avoid local restrictions.
We do not guarantee access from municipal beaches, piers, or city-owned shorelines.
 
4. Equipment and Safety Requirements
 
All guests must wear a life jacket and follow the guide’s instructions at all times. We provide all required safety equipment and basic training. Participation is contingent on completing a risk waiver form prior to launch.
 
You must be physically able to enter and exit a kayak from shallow water or floating dock conditions.
 
5. Refund and Cancellation Policy
 
We understand that plans may change. Our cancellation policy is as follows
 
If canceled 48 or more hours in advance, 80 percent refund
 
If canceled 1 to 47 hours in advance, 50 percent refund
 
If canceled less than 1 hour in advance, 25 percent refund
 
No-call or no-show results in no refund
 
 
Cancellations must be submitted by phone or email. Refunds are processed to the original payment method.
 
6. Risk and Liability
 
Kayaking and outdoor recreation involve inherent risks. By participating, you accept full responsibility for your safety and agree to
 
Assume all risks related to weather, water conditions, physical exertion, or equipment use
 
Release Superior Kayak LLC and all associated parties from any liability for injury, death, illness, or property damage, whether caused by negligence or otherwise

You may not copy, reproduce, or distribute site content without written permission

8. Privacy Policy
 
We collect only the personal data necessary to process your reservation and communicate with you. Your information will never be sold or shared with outside parties. We may contact you occasionally with updates, schedule changes, or promotional offers related to our services.
 
9. Club Membership Disclosure
 
Some tours may take place under the structure of a private, noncommercial activity group. In such cases
 
Your payment is treated as a membership contribution and not a purchase of goods or services
 
All experiences are educational gatherings and are free to members at the time of participation
 
No sales or solicitations occur in jurisdictions where such activity is restricted
 
Participation includes agreement to a waiver of liability and acknowledgment of noncommercial intent
 
 
This structure allows us to operate within federal and tribal jurisdictions and supports indigenous access rights and stewardship in the Apostle Islands area.
 
10. Governing Law and Jurisdiction
 
All operations are managed from the Red Cliff Reservation. Any disputes must be submitted in writing within 30 days of the event. All matters are governed by the laws of the Red Cliff Band of Lake Superior Chippewa.
