Code of Good Practices

Our mission is to empower people to experience the Apostle Islands in the most authentic and accessible way—by offering the best locations to explore and the smoothest path to get there. We focus on showcasing the region’s natural beauty while avoiding unnecessary restrictions or bureaucracy.

Welcome to Bayfield Kayak, operated through the Apostle Islands Adventure Club, a private, non-commercial organization run by Red Cliff tribal members. By using our website or participating in any activity, you agree to the following Terms and Conditions.

Introduction

These terms and conditions apply to all services provided by Apostle Islands Adventure Club and Superior Kayak LLC (www.bayfieldkayak.com) and may be updated periodically. By using our website, mobile site, or booking system (collectively, the “Platform”), you agree to these terms and acknowledge our privacy policy.

We act as an intermediary platform to promote, facilitate, and aggregate trips, lodging, and tours from various providers. These providers (referred to as “Trip Providers”) may have their own policies and terms, which you must also follow when making a reservation.

Payment and Refunds

Payments are processed securely via third-party payment processors. In some cases, the Trip Provider may require full or partial payment in advance.

We are not the merchant of record for payments; all bookings are processed on behalf of the Trip Provider. Refunds or cancellations are subject to the provider’s terms and this platform’s cancellation policy.

Membership and Waiver

By booking a date and time, you acknowledge that you are joining a private club gathering, not purchasing a commercial service. Your payment is considered a membership fee donation, not a payment for goods or services.

All club activities are educational, not-for-profit gatherings and are free to members on the date and time of participation. You acknowledge that:

All activities are entered into at your own risk.

Membership fees may change.

You are not paying for kayaking, lodging, or other goods/services.

By participating, you waive all liability and agree to hold harmless Superior Kayak LLC, its partners, and affiliates from any claims related to injury, property damage, or death, whether caused by negligence or otherwise.

Terms and Conditions

Welcome to Bayfield Kayak, operated by the Apostle Islands Adventure Club, a private, non-commercial organization run by Red Cliff tribal members. By booking, participating in a tour, or using our website, you agree to the following Terms and Conditions.

1. Safety & Weather Conditions

Kayaking on Lake Superior is inherently risky. Conditions can change rapidly, especially on the west side of the Bayfield Peninsula (Meyers Beach, Devils Island, Sand Island). Safer, calmer alternatives include Romans Point, Chequamegon Bay, and Basswood Island.

If weather makes the primary sea cave session unsafe, we may:

  • Reroute your session to a safer alternate destination.
  • Transfer your booking to another reputable outfitter.
  • Refund or reschedule only if we cannot offer an alternate cave tour from our listed options.

We do not refund based solely on location changes due to weather.

2. Launch Locations & Access

All tours launch from a pontoon boat or sandbar, either at a dock or by wading into shallow water. This approach avoids restrictive local ordinances and lets us operate directly from federal waters or tribal land. Launching from beaches within municipalities is not guaranteed or typical.

3. Third-Party Bookings

We may transfer or sell your booking to another outfitter operating the same tour. These outfitters are vetted and maintain our standards. You will be notified in advance if this occurs.

4. Refund & Cancellation Policy

  • 48+ hours before tour: 80% refund
  • 1 to 47 hours before tour: 50% refund
  • Less than 1 hour before tour: 25% refund
  • No-call/no-show: No refund

Cancellations must be submitted via phone or email. Refunds are processed to the original payment method.

5. Risk & Waiver

By participating, you acknowledge and accept all risks associated with kayaking, boating, and water-based activities. You release Superior Kayak LLC, the Apostle Islands Adventure Club, and all associated individuals or organizations from liability for injury, illness, death, or property damage.

6. Website Usage

  • All content on www.bayfieldkayak.com is protected by copyright.
  • You may not copy, distribute, or use materials without permission.
  • We are not responsible for third-party links or external sites.

7. Privacy Policy

We respect your privacy. Personal information you provide during booking is used only to manage your reservation and for internal purposes. We never sell your data.

8. Apostle Islands Adventure Club Membership

BayfieldKayak.com operates under the Apostle Islands Adventure Club, a private club run by Red Cliff tribal members.

  • Membership dues support club operations.
  • All club activities are free and take place within the ceded territory or on tribal land.
  • Club events are non-commercial and protected under tribal and federal treaty rights.

9. Jurisdiction

We launch from federal waters or tribal jurisdiction to avoid illegal or overreaching municipal ordinances that restrict tribal and public access to shoreline launches. By joining a tour, you acknowledge and support these treaty rights.
